FOTOMATÓN BALEARES PROMOTIONS ON SOCIAL NETWORKS
 

1. The organizing company.
   Fotomatón Baleares (hereinafter referred to as "THE ORGANIZER"), located in Mallorca, Palma CP.: 07015, with CIF 49920536W, is organizing a COMPETITION called "Fotomatón Baleares Contest".
    

2. Distinction from Facebook and Instagram.
   Facebook and Instagram do not sponsor, endorse or administer this promotion in any way, nor are they associated with it.
   The user completely distances himself from Facebook and Instagram and is aware that he communicates his data to THE ORGANIZER and not to Facebook or Instagram.
   The information provided will be used to: administer the participant's participation and communicate the final prize.

3. Goal and mechanism of competition.
   
   The prize of the raffle will be indicated in each published title of the social network.
   
   Basic requirements for participation:
   Be a fan or become a fan of the Fotomatón Baleares page.
   "Like" the competition post.
   Leave a comment by linking or tagging friends.
   
   No voting is required, participation in the raffle is sufficient if you meet the above conditions.
   Unsuitable entries will be deleted.
   
   Participation in the Contest entails the transfer and express authorization of all intellectual property and pictorial rights to the entries submitted, so that the participant transfers to Fotomatón Baleares the exploitation rights of an intellectual, industrial and/or pictorial nature that belong to him or derive from the conditions for participation in the Contest submitted contributions.
   A minimum of 50 guests is required to host the event.
    

4. duration and scope.
   The event will take place in Mallorca. The date and time of the event are agreed with the organizing company, the duration of the service is a maximum of 2 hours.
    

5. Requirements for participation.
   Anyone over the age of 18 who is a fan of the official Facebook and Instagram page @fotomatonbaleares and who has a real user profile on Facebook and Instagram can enter the "Competition".
   The following persons are excluded from participation: Company employees, fraudulent profiles or minors.
    

6. Selection of Winner(s), Alternates, Communication and Delivery.
   The names of the winners will be published on Instagram, Facebook and our website www.fotomaton-baleares.com and will be announced via a link on the Fotomatón Baleares Facebook and Instagram pages within a maximum of 10 days after the end of the competition.
   
   To protect their privacy, winners will be announced using the name they provided when they entered.
   
   Once nominated, they must contact the following telephone numbers +34 609 30 41 95 or private message the Promoter's Facebook and Instagram pages with a telephone number for THE ORGANIZER to contact. If the winner does not respond within ten calendar days of the publication of the winners on the wall, via chat on the social network where the prize draw was published, via Whatsapp or by phone from Fotomatón Baleares (+34 609 30 41 95), the prize will be forfeited his win and/or becomes void.
    

7. Prices.
   The service at the winner's event, with the printing of a maximum of 2 copies per photo strip and a USB stick with all the photos taken by the photo booth. The duration of the service is a maximum of 2 hours.
    

8. Acknowledgments, Permissions and Transfer of Rights.
   The winners and participants in this Promotion expressly authorize the Promoter to reproduce their name, surname, likeness and any other information they have provided in the context of advertising and/or promotional activities related to this Promotion use and distribute, in any media, including the Internet, and publish photos of the winners on the website, without these activities giving rise to any right to compensation or benefits, other than the delivery of the prize won in accordance with these rules.
   
   The participant grants Fotomatón Baleares, without limitation, all the rights and images related to his participation and contribution to the competition, in particular the rights of exploitation (reproduction, distribution, public communication and transformation).
   
   The transfer of the above rights is made in any way and for the legal duration of the said rights and for worldwide scope, and entitles their exploitation in any way, on any support, in any format and by any technical process.
   
   The participant transfers to Fotomatón Baleares all the rights and the right to his own image, which are connected with his participation and his contribution to the competition, in particular the exploitation rights (reproduction, distribution, public communication and transformation).
   
   The above rights may be ceded in any way and during the legal term of the rights mentioned and for the worldwide scope of application, authorizing their exploitation in any way, with any support, in any format and by any technical process.
   
   The participant expressly authorizes Fotomatón Baleares to use the data, photographs, images and other works provided, and more generally any other information that is deemed appropriate or necessary for the implementation or commercial exploitation, within the meaning of current legislation.
   In any case, the aforementioned rights are transferred free of charge.
    

9. Responsibility.
   Fotomatón Baleares does not enter into any obligation or contractual relationship with the participants and reserves the right to delete any content without the consent of the participant and disclaims any liability that may arise from errors in receiving the comments due to deficiencies in the Internet service.
   
   Likewise, Fotomatón Baleares reserves the right to reject any Submission that it deems fraudulent or inappropriate within the meaning of these RULES.
   
   Fotomatón Baleares is not liable for any other damages, including those not expressly mentioned in the general terms and conditions.
   
   By receiving the Prize, Winner agrees to indemnify Fotomatón Baleares, its affiliates, suppliers, dealers, advertising agencies and prize suppliers, and their respective parent companies and the officers, directors, employees and agents of such companies (collectively, the "Released Parties") indemnify you against any claim or demand arising out of your participation in the Contest or the receipt or misuse of any prize, to the fullest extent permitted by applicable law.
   
   In no event will this indemnity affect your mandatory rights. By participating in the competition, the winner agrees that Fotomatón Baleares and its agents may use the winner's data, such as name, surname, taste, photo, voice, options and/or e-mail address and postal address, for promotional purposes in any media worldwide for one year without any payment or consideration.
   
   Fotomatón Baleares reserves the right to cancel, suspend and/or modify all or part of the Contest if fraud, technical failures or other factors beyond the control of the Promoter prevent the integrity or proper functioning of the Contest.
   
   Fotomatón Baleares also reserves the right to disqualify any person it finds, in its sole discretion, to tamper with the entry process or the operation of the Sweepstakes, or to violate these Rules or any other promotion, or engage in disruptive or unsportsmanlike conduct.
   
   Any attempt to intentionally interfere with the lawful operation of the Contest may constitute a violation of criminal and civil laws, and in the event of such violation, Fotomatón Baleares reserves the right to recover damages from any person to the extent permitted by law.
   
   The failure of Fotomatón Baleares to comply with any provision of these Rules of Procedure shall not constitute a waiver of that provision.
   
   Fotomatón Baleares is not responsible for any anomalies in the operation of the Fotomatón Baleares profile on Facebook that, for technical or other reasons beyond Fotomatón Baleares' control, could interrupt, suspend or prevent the development and/or participation in the Contest.
   
   This giveaway is not sponsored, endorsed, administered by, or in any way associated with Facebook or Instagram. Accordingly, the participants release Facebook and Instagram from any liability. To the fullest extent permitted by law and without prejudice to indispensable rights.
   
   Fotomatón Baleares is not responsible for:
   (1) False or inaccurate information, whether provided by entrants, typographical errors, or by any programs or devices associated with or used in the Sweepstakes.
   (2) Technical failures of any kind, including but not limited to malfunctions, interruptions, disruptions in telephone lines and network hardware or software.
   (3) Unauthorized human intervention at any time during entry or the Contest.
   (4) Technical or human errors that may occur in the conduct of the Contest or in the treatment of entrants or in the administration or service of the Event.
   (5) Personal injury or damage to property that may be caused directly or indirectly, in whole or in part, by the contestants' participation in the Contest or receipt of the prize, or the proper or improper use of the same.
   
   No more prizes will be awarded than specified.
   
   Except where prohibited, participants agree that:
   (1) Any dispute, claim or demand arising out of or in connection with this Sweepstakes or any prize will be decided on an individual basis exclusively by the courts of Palma Capital, with any such claim, judgment or award limited to actual out-of-pocket expenses incurred plus the cost of registering for the Sweepstakes, but will in no event include attorneys' fees.
   (2) Under no circumstances will the participant receive payment for any costs other than those actually incurred, and the participant hereby waives all rights to recover indirect, punitive, incidental, consequential and other damages and all rights to have such damages in increased or increased in any way.
   All matters and questions related to the structure, validity, interpretation and implementation of these rules or the rights and obligations of the participant and the organizer in connection with the competition shall be governed by and construed in accordance with the laws of Spain, without any Conflict of law rules (whether in Spain or in another jurisdiction) apply, which would result in the application of the laws of a jurisdiction other than that of Spain.
    

10. Privacy.
    The data of the participants will be processed in accordance with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data (LOPD) and Royal Decree 1720/2007, of December 21, adopting the Regulation implementing Organic Law 15/1999, of December 13. December on the protection of personal data (RDLOPD).
    In accordance with the provisions of article 5 of the LOPD, the personal data of the participants will be included in the file "SORTEOS Y PROMOCIONES" of which "Fotomatón Baleares" is responsible and owner, in order to manage the development of the promotion and the delivery of the prizes.
    
    Likewise, the data of the participants can be used for advertising purposes or for the commercial promotion of products, services and activities in electronic communications.
    
    The participants expressly authorize the Fotomatón Baleares to inform them of new services, promotions and commercial actions that the company may subsequently organize by sending emails and to communicate the data to all the companies of the group to which it belongs .
    
    The rights of opposition, access, rectification or deletion of this data can be exercised at any time by sending a request to any of the means of communication indicated above.
     

11. acceptance of the rules.
    Mere participation in the Contest implies acceptance of these Rules, so the exclusion of the Participant, resulting in total or partial non-acceptance of these Rules, will release Fotomatón Baleares from fulfilling the obligation entered into with the Participant.
